Terms and Conditions

For Commissioning Clients
If you have engaged Barrenjoey Inspections directly to conduct an inspection:

• Your inspection, report, and all related services are governed solely by your Inspection Agreement.
• These website terms and conditions do not apply to your order.
• If there is any conflict, your Inspection Agreement prevails.

For Report Access Clients (Deposit Access Edition)
If you are making a Report Access Deposit for access to a property inspection report commissioned by a third party (e.g., another purchaser or the vendor), you agree to the following Terms and Conditions:

• Report Access: Upon payment of the Report Access Deposit (inclusive of GST), you will receive access to the inspection report, subject to these Terms and Conditions. This deposit also provides direct telephone access to the inspector for report‑related queries.
• No Warranty: The report has been prepared with due care; however, no warranty is provided regarding accuracy or completeness for clients accessing a third‑party‑commissioned report, and it may not be suitable for your particular purposes.
• No Reliance and Independent Advice: You acknowledge that the report was prepared for a different commissioning client and for their purposes only. You must not rely on this report as a substitute for your own independent inspection, legal advice, or other professional advice, and you should obtain your own reports and advice before making any decision in relation to the property.
• Warranty Option for Successful Purchaser: If you are, or later become, the successful purchaser of the property, you may obtain standard warranties and receive a Warranty Edition of the report by making an additional Warranty Upgrade Payment of $349 (incl. GST) within sixty (60) days of the contract for sale and purchase exchange date. Any such warranty relates only to the condition of the property as at the original inspection date and does not cover any change in condition after that date.
• Vendors and Property Owners: If you are the property owner, vendor, or a person acting on behalf of the vendor, you acknowledge that this report is not provided for the purpose of marketing the property, supporting any particular asking price, or securing a sale. To the fullest extent permitted by law, you agree that you will not make or threaten any claim against Barrenjoey Inspections or its inspector(s) alleging that the contents of the report have caused or contributed to the loss of a sale, reduction in sale price, or any related loss.
• Release and Indemnity: To the fullest extent permitted by law, you release and discharge Barrenjoey Inspections and its inspector(s) from all claims, actions, demands, losses, and liabilities you may have in connection with your access to, or use of, this report. You also agree to indemnify and hold harmless Barrenjoey Inspections and its inspector(s) from and against any claim made by any third party arising out of or in connection with your provision of this report (or any copy of it) to that third party or their reliance on it.
